These Terms & Conditions (“Terms”) govern your use of the PitchFree platform operated by PitchFree Ltd, registered in England & Wales. By creating an account or browsing the platform you agree to these Terms in full. If you do not agree, please do not use PitchFree. These Terms apply to all users worldwide, with additional rights preserved for users in the United Kingdom and European Economic Area.
Introductory Pricing Notice
Paid subscription plans are offered at an introductory rate for the first 2 calendar months from the date of first subscription. After the introductory period your subscription will automatically renew at the standard rate shown below. You will be notified by email 14 days before your introductory rate expires. Introductory pricing is available once per customer and cannot be combined with other promotions.

1. Definitions
In these Terms the following words have the meanings set out below:
- "Platform"The PitchFree website at pitchfree.co.uk and any associated mobile or API interfaces.
- "PitchFree", "we", "us", "our"PitchFree Ltd, registered in England & Wales.
- "User"Any person who accesses or uses the Platform, whether as a Buyer or Seller.
- "Seller"A User who creates Listings on the Platform, whether on a Free Tier or paid subscription.
- "Buyer"A User who browses and makes enquiries about listed items. No account is required to browse.
- "Listing"An advertisement for a secondhand item posted by a Seller on the Platform.
- "Free Tier"The no-cost access level permitting up to 5 active Listings at any time with basic features.
- "Casual Plan"The paid seller subscription at the introductory rate of £5/month (standard £8/month) for individuals selling personal items.
- "Pro Plan"The paid seller subscription at the introductory rate of £15/month (standard £20/month) including bulk upload and advanced features.
- "SaaS Organisation Plan"The paid subscription at the introductory rate of £99/month (standard £149/month) for businesses, resellers, and multi-user organisations requiring API access.
- "Introductory Period"The first 2 calendar months from the date a User activates a paid subscription for the first time.
- "Standard Rate"The recurring subscription price that applies after the Introductory Period expires.
- "Transaction"An agreement between a Buyer and Seller for the sale of an item. PitchFree is not a party to any Transaction.
- "Postcode Area"The outward code of a UK postcode (e.g. "NG7"), which is the only location data publicly visible on Listings.
- "Address Reveal"The event, following mutual Deal Confirmation by both parties, at which the Seller's full postcode and contact details are shared with the Buyer.
- "Unsold Item"A Listing that a Seller marks as unsold and routes to charity donation or recycling.
- "Content"Any text, images, descriptions, or other material uploaded to the Platform by a User.
2. Acceptance of Terms
2.1 Agreement
By accessing the Platform, creating an account, or placing or responding to a Listing you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2.2 Age Requirement
You must be at least 18 years old to create a seller account or make purchases. Users aged 13–17 may browse the Platform only with the consent of a parent or legal guardian. We do not knowingly collect data from children under 13.
2.3 Capacity
If you are using the Platform on behalf of a business or organisation, you confirm you have authority to bind that entity to these Terms and that the entity accepts these Terms. Organisations subscribing to the SaaS Organisation Plan confirm they are a legal entity duly incorporated or registered.
2.4 Updates
We may update these Terms from time to time. Material changes will be notified by email to registered users at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
3. Seller Subscription Plans
PitchFree offers four access tiers for Sellers. Browsing and buying is always free with no account required. Subscription fees for paid plans are charged monthly in advance via Stripe.

3.1 Introductory Pricing
Each paid plan is offered at an introductory rate for the first 2 calendar months from the date a customer activates that plan for the first time. The introductory rate applies once per customer per plan level. After the Introductory Period, the subscription will automatically renew at the Standard Rate. PitchFree will send a reminder email no later than 14 days before the transition to the Standard Rate.
The Standard Rates are: Casual Seller £8/month; PitchFree Pro £20/month; SaaS Organisation £149/month. Standard Rates are inclusive of VAT where applicable.
3.2 Free Tier Limitations
The Free Tier permits a maximum of 5 active Listings at any one time. A Listing counts towards this limit from the moment it is published until it is marked as sold, donated, recycled, or deleted. Once 5 active Listings are in place, new Listings cannot be created until an existing active Listing is removed or de-activated. The Free Tier does not include AI price suggestions, bulk upload, or priority placement.
3.3 Billing
Subscriptions are billed monthly on a rolling basis. Your first payment is taken immediately on subscribing. Subsequent payments are taken on the same calendar date each month. All prices quoted for paid plans include VAT where applicable. The SaaS Organisation Plan is invoiced monthly in arrears; all other plans are charged in advance.
3.4 Cancellation
You may cancel your subscription at any time from your account dashboard or by contacting support@pitchfree.co.uk. Cancellation takes effect at the end of the current billing period. You retain seller access and your active Listings remain visible until the period ends. No partial-month refunds are issued unless required by applicable law. On cancellation, your account reverts to the Free Tier (5-listing limit) rather than being deleted.
3.5 Failed Payments
If a payment fails, PitchFree will retry the charge up to 3 times over 5 days. If payment remains outstanding after that period, your subscription will be suspended, your Listings hidden from buyers, and your account downgraded to the Free Tier. We will notify you by email at each retry failure.
3.6 Refunds
Subscription fees are non-refundable except where required by the Consumer Rights Act 2015 or other applicable law. Users in the UK have a statutory 14-day cooling-off period from the date of first subscription. A full refund may be requested during this period provided no Listings have been created (creation of a Listing constitutes commencement of the digital service).
3.7 Plan Changes & Upgrades
You may upgrade from any plan to a higher plan at any time. The price difference is prorated for the remainder of the current billing period. Downgrades (including cancellation to Free Tier) take effect at the next renewal date. Upgrading during the Introductory Period does not reset or extend the Introductory Period; the introductory rate for the new plan applies from the upgrade date for the remainder of the original 2-month Introductory Period.
3.8 SaaS Organisation Plan — Additional Terms
Organisations on the SaaS Organisation Plan may create up to 10 sub-accounts for team members. The account holder is responsible for all activity under sub-accounts. API access is subject to a fair-use rate limit (detailed in the API documentation). PitchFree may vary the API rate limit on 30 days' notice. The SaaS Plan requires a minimum 3-month commitment; early termination will incur a fee equal to the remaining months' Standard Rate.
4. Privacy & Address Protection
PitchFree is designed so that buyers and sellers can trade safely without exposing personal details publicly. This section explains how location and contact data is handled on the Platform.
4.1 Postcode Area Display Only
Listings publicly display only the Postcode Area (the outward code, e.g. “NG7 area”), never the full postcode or street address. This allows buyers to find items near them while protecting the Seller's home address from public exposure.
4.2 Masked Messaging
All buyer-seller communication takes place inside PitchFree's internal messaging system. Personal email addresses, phone numbers, and home addresses must not be shared in early-stage messages. The Platform does not expose contact details until an Address Reveal has been completed (see clause 4.3).
4.3 Secure Address Reveal
The full collection address and Seller contact details (full postcode and phone number) are shared only when both the Buyer and the Seller independently confirm a deal using the “Confirm Deal” function within the conversation. Once both parties have confirmed:
- A one-time, in-conversation message is generated by the Platform containing the Seller's full postcode and phone number.
- This message is visible only to the two parties in that specific conversation.
- The Address Reveal is a permanent, irreversible action; confirmed deal details cannot be retracted through the Platform.
Sellers should not accept pressure from Buyers to reveal their full address via public Listing text or early messages. Report any such pressure to safety@pitchfree.co.uk.
4.4 Seller Responsibility for Address Sharing
Sellers who voluntarily share their full address in Listing descriptions or early messages do so at their own risk. PitchFree strongly advises against this and accepts no liability for any consequence of premature address disclosure by a Seller.
4.5 Data Retention of Messages
Conversation messages (including revealed address messages) are retained by PitchFree for up to 12 months for safety and dispute resolution purposes, after which they are permanently deleted. See our Privacy Policy for full details of data retention practices.
4.6 Safe Meeting Points
The Platform suggests nearby public safe-meeting locations on every item page to help Buyers and Sellers arrange a safe handover without the Seller needing to disclose their home address. PitchFree recommends meeting at a suggested public location (supermarket car park, train station, police station) for all in-person collections of portable items.
5. Buyer Rights & Responsibilities
5.1 Free Browsing — No Registration Required
Browsing Listings on PitchFree is completely free and does not require an account or registration. Creating a free account allows you to message Sellers and confirm deals. PitchFree will never charge Buyers a fee to browse, enquire about, or purchase items.
5.2 No Buyer Fees or Commission
PitchFree does not charge Buyers a buyer protection fee, service fee, or commission of any kind. The price shown on a Listing is the starting price negotiated directly between Buyer and Seller.
5.3 Accuracy of Listings
Listings are created by Sellers. PitchFree does not verify the accuracy, completeness, or condition of any item. Buyers are encouraged to ask Sellers questions and, where possible, inspect items in person before completing a Transaction.
5.4 Buyer Conduct
Buyers must not use the Platform to harass or threaten Sellers, make fraudulent enquiries, engage in price manipulation, attempt to obtain Sellers' personal details outside the Address Reveal process, or collect personal data about Sellers for any purpose other than completing a Transaction.
5.5 Consumer Rights
Items sold through PitchFree are generally sold by private individuals. Private sales are not covered by the Consumer Rights Act 2015, which applies to business-to-consumer sales. Where a Seller identifies themselves as a business, statutory consumer rights apply. Buyers should satisfy themselves as to the condition and provenance of an item before purchase.
6. Listing Rules & Prohibited Items
6.1 Seller Responsibility
Sellers are solely responsible for ensuring their Listings comply with these Terms, all applicable UK laws, and Trading Standards guidance. PitchFree is a platform intermediary and is not responsible for the accuracy or legality of individual Listing content.
6.2 Listing Standards
All Listings must:
- Accurately describe the item including any defects or damage
- Include at least one clear photograph of the actual item (not a stock image)
- State a genuine asking price in GBP
- Be for an item the Seller owns and has the legal right to sell
- Not exceed the active Listing limit of the Seller's plan
6.3 Absolutely Prohibited Items
The following must never be listed on PitchFree:
- Medicines — prescription or over-the-counter drugs, supplements marketed as medicines, medical devices requiring prescription
- Firearms & weapons — guns, ammunition, explosive devices, knives over legal limits, tasers, or any offensive weapon
- Alcohol & tobacco — including e-cigarettes, vaping products, and nicotine pouches
- Counterfeit & stolen goods — replica branded items, goods obtained through fraud or theft
- Hazardous materials — flammable liquids, corrosives, asbestos, radioactive material, biological agents
- Adult content — pornographic material, sexual services, adult toys labelled as such
- Live animals — including insects, fish, birds, and endangered species or their parts (ivory, etc.)
- Human remains or tissue — organs, blood, body parts, human biological material
- Financial instruments — currency, gift cards, vouchers, cryptocurrency, investment products
- Any item prohibited by English or Welsh law

6.4 Enforcement
We reserve the right to remove any Listing without notice that breaches these Terms. Repeated violations will result in permanent account suspension. Listings involving illegal items will be reported to Trading Standards, the Police, or other relevant authorities as required.
6.5 Reporting Prohibited Listings
To report a prohibited or suspicious Listing, email safety@pitchfree.co.uk with the Listing URL and reason. We aim to review all reports within 24 hours.
7. Collection & Payment Between Users
7.1 Direct Transactions
All Transactions on PitchFree are made directly between Buyers and Sellers. PitchFree is a classified advertising platform — we are not a party to any sale, do not hold or transfer funds between users, and do not provide escrow, payment processing, or buyer/seller protection for individual Transactions.
7.2 Agreed Payment Methods
Buyers and Sellers may agree any lawful payment method, including cash on collection, bank transfer, or authorised third-party payment apps. PitchFree recommends agreeing payment terms clearly before completing the Address Reveal step.
7.3 Cash on Collection
Many Transactions complete via cash on collection, consistent with the Platform's car boot sale heritage. Sellers should only release an item once payment is confirmed. Buyers should inspect items before paying. We recommend photographing the item and payment exchange as a record.
7.4 Safe Collection Advice
PitchFree strongly recommends:
- Meeting at a public safe-meeting location (car park, community centre, train station) where possible
- Bringing a friend or family member for high-value or bulky item collections
- Not sharing your full home address until both parties have confirmed a deal via the Platform
- Paying by bank transfer rather than cash for items over £100
- Keeping Platform message records in case of later dispute
- Arranging daytime collections wherever possible
7.5 No Platform Liability for Transactions
PitchFree accepts no liability for: non-payment by Buyers; items not as described; loss or damage during collection; injury or property damage during a meeting; or any other issue arising from a Transaction between Users. Users transact entirely at their own risk.
7.6 VAT, Tax & DAC7 Reporting
Sellers who are VAT-registered must display VAT-inclusive prices and issue VAT receipts on request. All Sellers are responsible for declaring Transaction income to HMRC. PitchFree may be legally required to share seller Transaction data with HMRC under the UK DAC7 (Digital Platform Reporting) Regulations 2023, and will do so in compliance with applicable law.
8. Charity Donation Flow
8.1 Donation Option
Sellers on any tier (including Free) may mark an unsold Listing for donation to a registered UK charity. By selecting this option the Seller agrees to make the item available for collection by or on behalf of the nominated charity at no cost to the charity.
8.2 Charity Partners
PitchFree works with a network of registered UK charities. The specific charity allocated to a donation may vary by postcode and item category. Sellers will be notified of collection arrangements by email within 5 working days of marking an item for donation.
8.3 Seller Obligations
Donated items must be clean, safe, and in the condition described in the Listing. Sellers must make the item available for collection at the agreed time and location. Failure to honour a donation commitment may result in removal of the donation feature from the Seller's account.
8.4 No Financial Benefit to PitchFree
PitchFree does not receive any financial benefit from donated items. Sellers may be entitled to claim Gift Aid or other tax relief directly with the receiving charity where applicable. PitchFree does not facilitate Gift Aid claims.
8.5 PitchFree's Role
PitchFree acts as a facilitator between Sellers and charity partners and is not responsible for the actions of charity collection partners once an item leaves the Seller's possession. All charity partners are independently registered with the Charity Commission for England and Wales.
9. Eco Recycling Flow
9.1 Recycling Option
Where an unsold item cannot be donated, Sellers on any tier may request responsible recycling. PitchFree arranges collection by a licensed waste carrier for processing at an approved UK recycling facility. Recycling collection is available to all tiers, including Free.
9.2 Eligible Items
Eligibility depends on item type, postcode, and local recycling partner capacity. PitchFree will confirm eligibility on request. Hazardous materials, liquids, medicines, and prohibited items are never eligible for the recycling programme.
9.3 Collection Arrangements & Costs
Recycling collection is included as a benefit of all paid subscription plans at no additional charge for standard household items. Free Tier users may use the recycling service subject to a nominal collection fee communicated at time of booking. PitchFree reserves the right to introduce a surcharge for unusually large or heavy items, with advance notice.
9.4 Environmental Commitment
PitchFree is committed to zero landfill for items processed through our recycling programme. An annual Sustainability Report is published on our website. PitchFree plants one tree for every 100 items sold across the platform in partnership with our reforestation partner.
10. Dispute Resolution
10.1 Disputes Between Users
Disputes between Buyers and Sellers are to be resolved directly between the parties. PitchFree is not a party to Transactions and cannot adjudicate disputes about item condition, non-payment, or collection arrangements. Users are strongly encouraged to resolve disputes amicably in the first instance.
10.2 Platform-Related Complaints
Complaints about PitchFree's conduct, a Listing decision, or an account action should be sent to support@pitchfree.co.uk with full details. We will acknowledge within 2 working days and aim to resolve within 10 working days.
10.3 Alternative Dispute Resolution
If we cannot resolve a complaint satisfactorily, you may refer it to an approved Alternative Dispute Resolution (ADR) provider. We will provide ADR provider details at the end of our internal process. UK online dispute resolution is also available via the EU ODR Platform.
10.4 Court Proceedings
Nothing in these Terms prevents you from bringing a claim in the courts of England and Wales, or in the courts of your country of habitual residence if you are a consumer in the UK or EEA. UK users may also contact Citizens Advice or Trading Standards for independent guidance.
10.5 Fraud & Safety Incidents
If you experience fraud, threats, or a safety incident connected with a Platform Transaction, contact the Police first (emergency: 999; non-emergency: 101), then report to PitchFree at safety@pitchfree.co.uk so we can take appropriate action including account suspension and cooperation with law enforcement.
11. Platform Rules & Conduct
11.1 Acceptable Use
You must not use PitchFree to:
- Post false, misleading, or fraudulent Listings or messages
- Harass, threaten, or abuse other Users
- Systematically scrape, harvest, or download data from the Platform without authorisation
- Circumvent technical measures protecting the Platform, including rate limits or access controls
- Create multiple accounts to evade a suspension, ban, or plan limit
- Use automated bots or scripts to create Listings or send messages
- Conduct commercial surveillance or build profiles of other Users without their consent
- Spam other Users with unsolicited messages, advertisements, or links
- Facilitate transactions for items that are prohibited under these Terms
11.2 Account Security
You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at support@pitchfree.co.uk if you believe your account has been compromised.
11.3 Content Standards
All Content you submit must be accurate, lawful, and must not infringe the intellectual property rights of any third party. You must own or hold a licence to all photographs uploaded to the Platform.
11.4 Termination by PitchFree
We may suspend or permanently close any account that breaches these Terms, without notice, at our sole discretion. Where practicable we will explain the reason. Termination does not entitle you to a refund of any subscription fees paid. On termination the licence granted in clause 12.2 to display your Content ends and your Listings will be removed.
11.5 Termination by You
You may close your account at any time by contacting support@pitchfree.co.uk. Account closure cancels any paid subscription from the end of the current billing period and initiates deletion of your Listings and personal data in accordance with our Privacy Policy.
12. Intellectual Property
12.1 PitchFree IP
The PitchFree name, logo, platform design, AI pricing algorithms, and underlying software are the intellectual property of PitchFree Ltd and are protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, reverse-engineer, or create derivative works from our IP without prior written consent.
12.2 Your Content
You retain ownership of all Content you upload to PitchFree. By uploading Content you grant PitchFree a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that Content on the Platform solely for the purpose of operating the service. This licence ends when you delete the Content or close your account.
12.3 Copyright Takedowns
To report Content that infringes your copyright, send a takedown notice to legal@pitchfree.co.uk including: identification of the work; identification of the infringing Content; your contact details; and a good-faith statement. We process valid notices promptly.
13. Limitation of Liability
13.1 Platform Availability
PitchFree is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free access to the Platform and may suspend it for maintenance without notice.
13.2 Exclusion of Warranties
To the maximum extent permitted by law, PitchFree excludes all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, in relation to the Platform and any Listings.
13.3 Cap on Liability
PitchFree's total liability for any claim arising from these Terms or use of the Platform shall not exceed the total subscription fees paid by you in the 12 months preceding the claim (or £50 where you are a Free Tier user).
13.4 Excluded Losses
PitchFree shall not be liable for: loss of profits, revenue, data, or goodwill; indirect or consequential loss; or any loss arising from Transactions between Users, whether or not we were advised of the possibility of such loss.
13.5 Statutory Rights Preserved
Nothing in these Terms limits PitchFree's liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded, including rights under the Consumer Rights Act 2015 for UK consumers.
14. Governing Law
14.1 English Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the law of England and Wales.
14.2 Jurisdiction
Subject to clause 14.3, the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.
14.3 Consumer Users
If you are a consumer (using PitchFree for personal, non-commercial purposes), nothing in these Terms affects your right to bring proceedings in the courts of your country of habitual residence if that country is within the United Kingdom or European Economic Area.
14.4 EU Consumers
EU consumers additionally benefit from mandatory consumer protection provisions of the law of their country of habitual residence that cannot be derogated from by agreement.
15. Global User Rights
15.1 Platform Scope
PitchFree is designed for use in the United Kingdom. Users outside the UK may browse the Platform but postcode-matching and Transaction features may not be available in all territories.
15.2 UK GDPR & Data Protection Act 2018
We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Full details are in our Privacy Policy. UK and EEA users have rights to: access; rectify; erase; restrict processing of; and port their personal data. Requests should be sent to privacy@pitchfree.co.uk.
15.3 EU GDPR
Where we process personal data of EEA residents, we comply with EU GDPR. EEA users may lodge a complaint with their local supervisory authority. Transfers of personal data from the EEA to the UK are made on the basis of the UK adequacy decision adopted by the European Commission.
15.4 California Users — CCPA
California residents have rights under the California Consumer Privacy Act (CCPA / CPRA) including: the right to know what personal information is collected; the right to delete personal information; the right to correct inaccurate information; and the right to opt out of the sale or sharing of personal information. PitchFree does not sell or share personal information for cross-context behavioural advertising. To exercise CCPA rights contact privacy@pitchfree.co.uk.
15.5 Australian Users — ACL
Australian users benefit from non-excludable consumer guarantees under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010). Nothing in these Terms limits rights that cannot lawfully be excluded under the ACL.
15.6 Canadian Users — PIPEDA / Bill C-27
Canadian users have rights under the Personal Information Protection and Electronic Documents Act (PIPEDA), and future rights under Bill C-27 when enacted, regarding access to, correction of, and deletion of personal information held by PitchFree.
15.7 Export Controls
You agree not to use the Platform in violation of any applicable export control or sanctions laws, including those of the United Kingdom, European Union, and United States.
15.8 Local Laws
You are responsible for complying with all local laws applicable to your use of the Platform in your jurisdiction, including laws governing the sale of secondhand goods, consumer protection, and tax on income from sales.
16. Changes to These Terms
16.1
We review these Terms periodically and may update them to reflect changes in law, regulation, Platform features, or our business model. The “Last updated” date at the top of this page shows when the Terms were last revised.
16.2
For material changes (those that significantly affect your rights or the price of your subscription), we will notify registered users by email at least 14 days before the new Terms take effect and display a prominent notice on the Platform.
16.3
Changes to subscription pricing (including the transition from Introductory to Standard Rates) are notified under clause 3.1 and are governed by the notice period in that clause. Non-material changes (e.g. clarifications, typographical corrections) take effect on publication.
16.4
If you do not agree to updated Terms, you must stop using the Platform and cancel your subscription before the effective date. Continued use after that date constitutes acceptance.
